Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Field Trip Club LLC ("Field Trip," "we," "us," or "our"). They govern your use of the Field Trip membership community, our website at fieldtripnyc.club, our mobile app, and the events we organize (together, the "Services").

By creating an account, purchasing a membership or a spot at an event, or attending an event, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Services. Many of our events take place at venues that serve alcohol. You are responsible for complying with all applicable laws, including those regarding alcohol consumption, and for your own conduct at events.

Your Account

You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly at [email protected] if you believe your account has been accessed without your permission.

Membership and Fees

Field Trip membership is a paid, recurring subscription. Your membership renews automatically at the start of each billing period until you cancel. We will show you the price and billing frequency before you sign up and will charge the payment method on file through Stripe.

Before you are charged, we present the subscription price, billing frequency, and renewal terms clearly and obtain your agreement to them. Your subscription then continues and renews automatically for successive billing periods at the price disclosed to you, until you cancel.

You can cancel your membership at any time from your account settings, using the same online account you used to sign up, and cancellation is effective for the next billing period. Cancellation takes effect at the end of your current billing period, and you keep access until then. We do not refund the unused portion of a billing period unless required by law. If we change the price of your subscription, we will notify you in advance, and the new price will not take effect until your next billing period after that notice.

Events, Tickets, and Payments

We organize curated outings to theater and cultural events. When you reserve a spot or purchase a ticket through the Services, your payment is processed by Stripe, and all sales are subject to the cancellation and refund policy below.

Many events take place at third-party venues and feature productions we do not own or control. By attending, you also agree to follow the rules of the venue and production. We are not responsible for the content, quality, scheduling, or cancellation of any performance, or for actions of a venue or production. If a venue or production changes or cancels an event, our cancellation and refund policy below governs what happens to your purchase.

Cancellations and Refunds

The terms below are our default event refund policy. Some events have their own refund terms, which will be stated on the event page and override this default, so always check the specific event before you book.

Event tickets are non-refundable. That said, most of our events have an active waitlist. If you let us know at least 24 hours before the event start time that you can no longer attend, and we are able to fill your spot from the waitlist, we will refund you. We can't guarantee a match, but we'll try. Requests made less than 24 hours before the event are not eligible for a refund.

When we resell your spot, your refund is the amount we recover for that spot, minus a $25 transfer fee:

  • If your spot resells at the full price you paid, you receive a refund of that price minus $25.
  • If we resell your spot for less than you paid, for example at a discount to fill it, your refund is based on the lower amount we actually recover, minus $25, not the original price you paid.
  • If the amount we recover is $25 or less, no refund is due.

If we are unable to fill your spot, or if you do not attend without arranging a transfer, your ticket is non-refundable.

If Field Trip cancels an event, you will receive a full refund to your original payment method.

Community Standards

Field Trip is a community built on people gathering in person. You agree to treat other members, hosts, performers, and venue staff with respect. The following are not permitted: harassment, discrimination, threats, intimidation, illegal conduct, and any behavior that endangers or seriously disrupts other members or an event.

We may remove you from an event, suspend, or terminate your membership for conduct that violates these standards, in our reasonable judgment and without a refund.

Assumption of Risk

Attending in-person events involves inherent risks, including gathering with others, travel, and venues that serve alcohol. You participate voluntarily and accept these risks. To the fullest extent permitted by law, you agree that Field Trip is not liable for injury, loss, or damage arising from your attendance, except where caused by our own gross negligence or willful misconduct.

User Content

If you post photos, reviews, messages, or other content through the Services, you keep ownership of it and grant Field Trip a non-exclusive, royalty-free license to use, display, and share it in connection with operating and promoting the Services and our community. You are responsible for what you post and agree not to share content that is unlawful, infringing, harassing, or harmful.

Intellectual Property

The Field Trip name, logo, website, app, and content are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose. You may not copy, resell, or commercially exploit any part of the Services without our written permission.

Communications

By providing your email address and phone number, you consent to receive communications from us related to your account, events, and membership. With your consent, we may also send marketing communications, including email, SMS, and push notifications. You can opt out at any time as described in our Privacy Policy, including by replying STOP to SMS messages.

Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Field Trip will not be liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim relating to the Services will not exceed the amount you paid to us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold Field Trip harmless from any claims, losses, or expenses arising out of your use of the Services, your content, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or to protect the community. You may stop using the Services and cancel your account at any time. Provisions that by their nature should survive termination will survive.

Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in New York County, New York, and you and Field Trip consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us at [email protected] so we can try to resolve the matter informally.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Services or by email. Your continued use of the Services after an update means you accept the revised Terms.
